Pittman MacIsaac & Roy have experience as successful counsel in many Alberta Court of King’s Bench trials. They have also been successful in cases the Alberta Court of Appeal, and the Tax Court of Canada. PMR Law has represented parties successfully before administrative boards and tribunals.
Shaun T. MacIsaac, K.C. is the lead litigation counsel for the firm. Shaun has conducted over 150 civil trials most of which have been successful. Shawna Nahal, another member of our litigation team, and appears in the courts regularly focusing on security enforcement and foreclosure. We have a new team of students at law that are joining our expanding practice.

The Litigation Process

Civil Litigation involves a preliminary assessment of the merits of the claim or defence at the outset. The process involves preparing a claim or defence setting out the argument for our client in the best possible manner. Relevant and material documents are then exchanged. Questioning is then done of parties or their legal representatives. Then, the case is set down for trial. At all stages, recommendations are made that facilitate settlement, which is always the preferred option, but only when the terms are reasonable. Administrative tribunals follow a similar pattern. Settlement Offers and mediations are also often used when cost-effective results can be achieved.

We have experience in defending claims advanced by groups of litigants in major cases and in class actions. The firm has many reported cases.

Some recent successful cases won by the firm before the courts include oil patch fraud, the rights of second mortgage holders when acquiring property by foreclosure, and the scope of the 2-year limitation period.
